A Burgh le Marsh resident says he will continue to fight against a controversial housing development which has been rumbling on for the past six years.

Former town councillor Doug Newey, who has experience in the building industry, feels a major developer who was granted permission for a series of properties with conditions to develop green areas, should have to stick to their original planning permission out of principle.

Stamford Homes North, now Linden Homes North, was granted permission in 2008 to build 47 properties in land adjoining Ingoldmells Road and Claremont Road, Burgh le Marsh, but the application came with a requirement for the developer to provide the Local Planning Authority with a management and maintenance plan for the communal areas associated with the site.

This included investment in play equipment and improved facilities for the community on Tinkers Green.

“The plan was supposed to include the development of Tinkers Green which is intended to be green space for the community and the developers are trying to get out of this with the removal of the clause from the original application,” said Doug Newey.

The developer applied to have the condition removed from the application, but this was refused and an acceptable scheme is yet to be submitted to East Lindsey District Council.

“As a result, the council is left with no option other than formal enforcement action to ensure the planning permission is implemented as granted. Linden Homes (North) was served with a Breach of Condition Notice by the council on December 19, and has 28 days from that date to submit details of their work to us,” said a spokesperson for East Lindsey District Council.

And Mr Newey believes if he hadn’t intervened and put his thoughts forward, he fears, this action may not have been taken.

“I have been keeping an eye on the paperwork over the years. I am very knowledgeable in the building trade and think it is wrong that developers have these issues and the cost of it often gets passed onto the buyers,” he said

“They should have to do what was originally granted in the application,” he added.
