A banned driver who drove with excess alcohol in his breath has been given a suspended jail sentence.
Dean Marshall, of 1 Hamilton Road, Alford, had 64 micrograms of alcohol in his breath when he was tested on the morning of September 18, the legal limit being 35mgs, a court heard.
Marshall, 39, had earlier admitted driving in Burgh le Marsh with excess alcohol in his system. He had also admitted driving while banned and failing to disclose to esure insurance he was a disqualified driver, stating he was the holder of a full driving licence.
District Judge Richard Blake sentenced Marshall to a suspended sentence order of 12 weeks' custody suspended for one year.
Marshall was given a two-month curfew between the hours of 8pm and 6am and ordered to complete the drink impaired drivers' Programme.
He was banned from driving for three years and ordered to pay £60 costs.
Prosecutor John Mitchell said at 8.50am on September 18 police on duty in Burgh le Marsh spoke to Marshall, the driver of a BMW, because it was suspected he was a disqualified driver.
Marshall's breath smelt of alcohol and a sample of his breath was found to contain 64 micrograms of alcohol, said Mr Mitchell.
